    Publikacja stanowi jedyny na rynku wydawniczym komentarz do tekstu ustawy o zachowaniu narodowego charakteru strategicznych zasobów naturalnych kraju. Autorzy poprzedzają analizę tekstu prawnego obszernym wprowadzeniem odnoszącym się do pojęcia zasobów naturalnych, ich kwalifikacji jako dóbr publicznych oraz znaczenia jakie „strategicznym” zasobom naturalnym nadaje podbudowa aksjologiczna, która legła u podstaw wprowadzenia komentowanej regulacji. W komentarzu poddano także analizie kontekst oceny znaczenia zasobów naturalnych z perspektywy funkcji ekosystemów i usług ekosystemowych.

    Lokalizacja pni pszczelich na tle regulacji prawa administracyjnego i prawa cywilnego

    The purpose of this study is to present a legal regulation relating to the location of bee trunks based on the regulations of the maintenance of cleanliness and order in the municipality and in the context of neighboring relations. We ask the question about the principles of acceptability of the location of urban bee-stubs in the urban areas and the thesis on the admissibility of such location, taking into account the criteria related not only directly to the requirements of art. 4 Law on the maintenance of cleanliness and order in municipalities, but also criteria derived from civil law. There is no doubt that beekeeping, apart from the above-mentioned quantifiable ecosystem benefits, may entail risks to the health and life of people, especially those affected by bee venom and as a source of such danger, and shall be considered immiscible within the meaning of the provisions of the neighborhood law.

    On the Subject of Testamentary Burden against the Background of German Law

    The making of a last will and testament by a testator is an act in law. The testator is entitled to make specific dispositions to execute their last will, such as identifying an heir, making ordinary or vindication legacies, or appointing an executor of the will. At the same time, the number of potential aims intended to be achieved by the testator corresponds to the number of possible life situations that cannot be resolved through the testator’s dispositions regarding their estate. It is therefore necessary to equip the testator with such legal means that will allow them to achieve both material and non-material objectives. This is the role of the institution of testamentary burden. It has been regulated in the Polish legal system only superficially; therefore, the author refers to the legacy of German legislation to offer a better understanding of the solution.

    Pojęcie strategicznych zasobów naturalnych – uwagi krytyczne

    Obowiązująca od ponad dekady ustawa o zachowaniu narodowego charakteru strategicznych zasobów naturalnych kraju wprowadziła do krajowego porządku prawnego szczególną kategorię zasobów środowiska – „strategicznych zasobów naturalnych”, poddanych co do zasady szczególnemu reżimowi prawnemu. Sposób rozumienia tego pojęcia, jego zakres przedmiotowy oraz relacja do innych pojęć języka prawnego i prawniczego, dotyczących zasobów środowiska nie był dotąd przedmiotem zainteresowania doktryny. Celem niniejszego opracowania jest prezentacja i wyjaśnienie podstawowych pojęć z zakresu gospodarowania zasobami środowiska i uznania ich za zasoby strategiczne kraju, wraz ze wskazaniem ratio legis oraz skutków prawnych przyjęcia takiej koncepcji jurydycznej w krajowym systemie prawa ochrony środowiska.
